Definitions:

Arrival: the start date of the period for which the Agreement between Recreant and LXRY Resort is entered.

Accommodation: any vacation accommodation for recreational purposes. 

Lessor: LXRY Resort/or its appointed manager of the accommodation to be let. 

Terms and Conditions: these terms and conditions which apply to all Contracts entered for the rental of an Accommodation with the Accommodation Provider between the holiday maker and LXRY Resort. 

Guests: all people who fall under the term Recreator and Co-Recreator and use the Accommodation and/or facilities of the Resort, as well as visitors to the Resort. 

LXRY Resort: the party with whom the Recreant enters into an Agreement. It is indicated at the bottom of the fee schedule. Agreement: the agreement for rental of Accommodation with the associated terms and conditions. 

Resort: the premises of LXRY Resort in which an Accommodation is located. Hirer: the (legal) person who makes the booking and enters into the Agreement.

Deposit: an amount that may be charged as an advance against any damage, including extra cleaning and the deployment of security, caused during the stay by (the actions of) guests. Any outstanding items may also be offset against the deposit. 

Website: the website(s) of the LXRY Resort used to create the Agreement Where a definition is formulated in the singular, it also applies to the plural and vice versa. 1. Destination and use

Villa LXRY is suitable for a maximum of 8 people. It is not permitted to occupy the property with more than the stated maximum number of people, except for babies in a crib. Main tenant must be at least 23 years old and be present throughout the rental period for supervision of youth/children also staying in the house. When booking, we will receive a copy of the main tenant's passport. The villas at the LXRY Resort are intended for vacation occupancy. Changes by the tenant to the destination or use are not permitted. The villa is delivered completely clean and in a tidy condition. Upon departure, the tenant must return it in a tidy condition (Cleaned up). Landlord assumes that everything is in place upon delivery, the dishes have been washed and the household appliances used have been cleaned. Cleaning costs will be charged to tenant separately. Tenant will respect the rental guidelines and treat the leased property and its contents neatly in all situations, including closing windows and doors in wind/rain, locking the property when absent and by turning off all electrical appliances when not in use.

 If a nuisance is caused to surrounding residents, Landlord reserves the right to terminate the contract with immediate effect. It is expressly prohibited (unless prior written permission is sought from the landlord) to host parties or other events at the LXRY Resort. If this is observed, the rental contract will be terminated with immediate effect and no refund of paid rent and/or deposit will follow.

 It is not permitted to transfer rights or sublet the property to third parties.

2. Payment and conditions 

To book, the tenant LXRY Resort must submit all the correct details through the www.lxryvillas.com website. The tenant will receive a confirmation email after the booking is completed. This confirmation email will display payment instructions. Your booking is completed when the deposit of USD 500 has been paid to LXRY Resort by bank transfer. The remaining amount (full rental price incl. taxes and other services) can be paid on arrival via the pin terminal. Before your arrival, please change your bank settings to world payments and, if necessary, increase your daily payment limit. To avoid inconveniences during your arrival, you can also pay the full amount in advance via bank transfer. Should the tenant decide to pay by credit card via the pin terminal at the resort, there will be an additional charge. 

Tenants will be granted access to the villa at the LXRY Resort when the full fee is paid, and a copy of a valid ID is also shown. In the event of cancellation, the booker will owe the following amounts to the LXRY Resort: 

• Deposit deposit of USD 500 will not be returned.

3. Deposit 

A deposit of USD 500 is paid for each period booked. This deposit will only be called upon if the tenant does not return the accommodation in the same state it was in at the time of checkout. The deposit will be refunded to your account within one month after check-out

4. Prices 

 Rental prices and other costs can be found on our website (www.lxryvillas.com). The beds are made upon arrival and sufficient towels and beach sheets are provided. At the intermediate cleaning these will be changed. 

Not included in the rental price: 

- Option of intermediate cleaning if tenant rents longer than 7 days (USD 195.00) and a mandatory final cleaning (USD 275.00).

5. Insurance and Cancellation  

We recommend good travel and cancellation insurance with world coverage. The villa and contents are insured against the usual risks and according to the usual conditions with a local insurance company. Tenant's goods are not insured under this policy. All reservations are final. If the reservation is cancelled within one month of the arrival date, there will be no refund on reservations made directly or through our website www.lxryvillas.com.

6. Loss, theft, damage/ destruction  

By booking, the tenant agrees to the terms and conditions. The tenant hereby indemnifies LXRY Resort from any liability in the event of loss, theft and breakage/destruction of the property's contents. Tenant also declares to treat the household goods and everything belonging to it in and around the rented property properly. Damage must always be reported to the manager. Landlord has no liability for loss / theft / injury / force majeure in case of failure of water, or power failure at tenant at the time of occupying the villa. 

Landlord is not liable for:

 - Theft, loss or damage of any kind during or because of a stay at Villa LXRY.

 - The malfunction or inoperability of technical equipment, temporary failure or malfunction in and around the house of water and / or energy.

 - Unannounced street work and construction work around the property.

 - Violation of applicable regulations and nuisance from activities outside the rented property.

 - Force majeure of any kind.

 - Accidents in and around the pool and terraces

.- Regarding accidents in or around the house, the manager or landlord cannot be held liable.

7. Visit of manager or landlord

Landlord or manager is allowed, by appointment with tenant to visit the villa, to verify that all obligations are carried out. This right must take into account the privacy of tenant and will be carried out moderately

8. Liability  

A tenant may be held liable for theft of and damage to contents if the theft occurs without traces of forced entry. In case of theft without signs of forced entry, for example by not locking windows or doors in absence, tenant is liable for damages suffered to property of landlord.  

9. Other  

Any printing errors in the terms and conditions, on our website or other forms and documents are subject to change. Landlord reserves the right to make interim changes. Landlord is under no circumstances liable and responsible for any damage caused to any persons involved or movable and immovable property.

 This rental agreement is exclusively governed by Curaçao law. All disputes arising from the rental agreement will be dealt with by the court in Curaçao.

10.  Pets are not allowed.

11.  Smoking in the house is not allowed.

12.  Holding large private or commercial events is not permitted without prior written permission.

Resort regulations

Together with the general terms and conditions applicable to the agreement between the tenant and LXRY Resort, the resort regulations form a single entity. Proper compliance with the resort regulations ensures the safety of our guests. We therefore hope for your cooperation and understanding. All terms used in the resort rules correspond to the definitions given in the general terms and conditions  

Arrival and departure

The time at which the accommodation is available is indicated in the travel information.

Use of accommodation  

Each accommodation has its own personal furnishings. It is not allowed to take outside furniture that belongs in the accommodation. (Garden) furniture must remain in its original position.

 The guest is obliged to keep the accommodation and its immediate surroundings in a neat and orderly condition. Waste must be deposited in the appropriate containers or waste bins at all times.  

Hygiene and maintenance

Waste must be deposited in the containers provided. It is not permitted to place waste next to the containers or elsewhere in the resort. Waste must be packed in sealed plastic bags. Leaving food in the resort is strictly prohibited for reasons of hygiene and pest prevention. 

Damaging public greenery is strictly prohibited.  

Use and return of keys, passes, etc.  

Bij het verlies van sleutels/pasjes etc. Worden kosten in rekening gebracht. Ter zake van de sleutel/pasjes is bedraagt dit € 50,- per sleutel. Het is niet toegestaan sleutels en/of pasjes in gebruik te geven aan anderen dan (mede)huurders. Bij vertrek dienen alle sleutels die de gasten ten behoeve van hun accommodatie hebben ontvangen, te worden ingeleverd bij de receptie of een inleverpunt van het resort.

(Night) rest and nuisance 

Guests of the resort must behave properly and refrain from anything that might reasonably cause offence or nuisance to the LXRY Resort or other guests.

 Between 11 p.m. and 7 a.m., sleep must be respected. Guests must strictly observe this night's rest. This includes no loud conversations, music or any other noise.

 It is not allowed to use music carriers, musical instruments and other objects that (may) cause noise pollution in such a way as to cause nuisance.

Public drunkenness is prohibited; a guest is not allowed to have opened bottles and/or cans of alcoholic beverage(s) outside the accommodation, other than on the associated terrace. A security service is present at the resort. Instructions from the staff (including this security service) must be followed immediately.

Maintenance and cleaning work/malfunctions 

The LXRY Resort reserves the right to carry out (cleaning) work around the accommodation (or have it carried out) from 11 a.m. onwards. 

Urgent breakdowns reported to the resort reception will be resolved as soon as possible.

 The LXRY Resort is entitled to enter the rented accommodation for inspection and/or to carry out (or have carried out) maintenance work, without the guest being entitled to a full or partial refund of the (rental) sums paid or still to be paid.

 The LXRY Resort shall give timely notice of such a visit. In urgent cases, the LXRY Resort may refrain from making such an announcement. 

Parking

A maximum of two motor vehicles per accommodation will be permitted unless otherwise specified. Motor vehicles belonging to visitors will not be permitted. The LXRY Resort reserves the right to change the parking policy in effect at any resort. 

Parking will be in designated areas. Parking on the roads is prohibited at all times.

 If these parking rules are violated, LXRY Resort reserves the right to remove the vehicle (or have it removed) and/or apply a wheel clamp. The costs thereof will be borne by the guest in question. 

Safety requirements 

The guest is obliged to immediately follow all traffic and safety regulations and the instructions of the staff.

In view of emergencies and departures and arrivals (of emergency services), paths, access roads and barriers must always remain clear of motor vehicles and other obstacles.

Normal traffic regulations apply in the resort. In deviation thereof, the speed limit on the resort for all vehicles is 10 km per hour, unless explicitly stated otherwise. Only destination traffic is permitted. Pedestrians and (playing) children always have the right of way.

Open fires are strictly prohibited on the resort. Due to fire hazard, leaving candles burning without someone present, throwing away burning cigars, cigarettes and matches is prohibited. Likewise, the presence of flammable and/or explosive substances is prohibited.

The use of a barbecue in the resort is not permitted. It is also prohibited: 

- Consuming alcohol outside the accommodation and/or outside the catering facilities.

- To use or possess (soft) drugs. 

- Possession of weapons prohibited by law.

Lost and found

 Found objects can be handed in at the resort reception. At the request of an already departed guest, the found object may be returned to him or her at the guest's expense and risk (cash on delivery). The LXRY Resort shall never be liable for any damage to the found object. 

If the owner of a found item does not report within one month of the issue of the found item, the owner will be considered to have relinquished possession of it. 

Removal from the premises/denial of access.

 All guests must strictly comply with the rules and regulations contained in the general terms and conditions and resort regulations and strictly follow instructions given by the LXRY Resort staff and/or any security service present in any form or context. 

In the event of a breach of these conditions and rules or failure to follow the instructions of the staff, the LXRY Resort shall be entitled to remove the guest from the resort and deny him further access to the resort, without entitling the holiday-maker to a full or partial refund and/or discount on the (rental) sums paid or to be paid, without prejudice to the right of the LXRY Resort to claim compensation for the damage caused by the breach. As a rule, a warning will be issued first. In urgent cases, at the sole discretion of the LXRY Resort, this may be waived, and the guest will be immediately removed and denied access to the resort.

Rules for groups and/or specific cases

General

 The holidaymaker who has booked for a group is requested to always report to the reception desk upon arrival of the group. The LXRY Resort will ask him to show his ID and (may) request him to provide the names of the group members. Each guest is obliged to show his identity document at the first request of the LXRY Resort or its (security) staff. Guests accept the community standards and will not engage in activities which could be polluting, dangerous, harmful, disruptive, unhealthy and/or a nuisance to the environment. A security service is also available at the resort. Instructions from the staff (including this security service) must be followed immediately. If upon arrival, or during stay, it is found that there are unaccompanied youths (persons who have not yet reached the age of 23 years and are traveling without their parents and/or guardians or other accompanying persons who are 23 years of age or older), while the booking has been made by a third party who is 23 years of age or older, the LXRY Resort reserves the right to cancel the contract with immediate effect, without refund of the travel price. The vacationer who books while all fellow vacationers are under 23 years of age must accompany the group at all times. Once it is determined that this holidaymaker has not arrived or has left earlier, for whatever reason, the group will be considered "youth traveling alone" and will be treated as such by the General Conditions and these resort regulations. 

Unforeseen cases 

In cases not covered by the general terms and these resort regulations, Curacao law shall apply
